LAWS 597 - Covenant Not to Compete and Trade Secrets Litigation

Course Description

This will be a skills heavy course focusing on the litigation of a covenant not to compete and trade secrets case in state court. This type of litigation is extremely fast-paced, with much of the work occurring within a 2 to 3 week period that starts when the client(s) retain counsel and quickly moves through analysis of the substantive issues, factual investigation, counseling the client on that analysis and litigation strategy, the drafting and filing of pleadings, a request for a temporary restraining order, expedited discovery, and, finally, the submission of and hearing on a Motion for Preliminary Injunction. This course will simulate that process, with students performing a somewhat streamlined version of the work of practicing attorneys in this high-profile and important area of the law.Prerequisite: LAWS 504, LAWS 509, LAWS 523, LAWS 524, LAWS 529, LAWS 544.
